About these terms
These terms apply when you use vesprebuds.com or buy from us. By placing an order you agree to them, so please read them.
They are between you and Vespré, a sole trader business registered in the United Kingdom at 20 Kylemore Crescent, Motherwell, Scotland, ML1 3XP. You can reach us at hello@vesprebuds.com.
Who can buy from us
You must be at least 18 years old to place an order, and you must be able to enter a binding contract where you live.
Our products
We sell reusable silicone earplugs designed for sleep, in four shapes, and a silk sleep mask. Earplugs are sold by the pair, and our Buy 2, get 1 free offer applies automatically in the cart.
We describe fit, materials and contents as accurately as we can. Colours may look different on your screen than in person, and product photography is illustrative.
We make no medical claims. Our products are not a medical device, are not a treatment for insomnia, tinnitus, apnoea or any other condition, and are not certified hearing protection for occupational use.
We do not publish a decibel figure. When we eventually publish one, we will name the standard it was tested to alongside it. A number without a standard is not information.
Health and safety
Our earplugs reduce noise. They do not remove it, and we do not claim they do.
- Do not rely on them in any situation where hearing an alarm, a warning, a vehicle or another person is a safety requirement.
- Do not use them while driving or operating machinery.
- If you have an ear condition, an ear infection, grommets, a perforated eardrum, or a history of ear problems, speak to a doctor or an audiologist before using earplugs.
- Stop using them and seek advice if you experience pain, irritation, discharge or a change in your hearing.
- Keep them clean, and do not share them with anyone else.
- Keep them away from young children. They are small and are a choking hazard.
Prices and payment
All prices are shown in United States dollars and include no hidden fees. Shipping is free on every order until the New Year.
Prices may change at any time, but a change will never affect an order you have already placed.
Payment is taken at checkout through Shopify Payments. If your bank charges a currency conversion or foreign transaction fee, that is between you and your bank and is outside our control.
If a product is listed at an obviously incorrect price, we may cancel the affected order and refund you in full rather than fulfil it at the wrong price. We will tell you if this happens.
Your order and when the contract forms
Placing an order is an offer to buy. It is not accepted at the moment you pay.
A contract is formed when we send you a dispatch confirmation. Until then we may decline your order, for example if the item is unavailable, if we cannot deliver to your address, if the price was wrong, or if we suspect fraud. If we decline, you are refunded in full.
Availability
Stock is limited and some colours are held in small quantities. If an item becomes unavailable after you order, we will contact you and refund you in full, or offer an alternative if you prefer.
Delivery, risk and ownership
Delivery times and costs are set out in our shipping policy, which forms part of these terms.
Risk in the goods passes to you when they are delivered to the address you gave us. Ownership passes to you when we have received payment in full.
Delivery estimates are estimates, not guarantees. Where a delivery is significantly late, our shipping policy sets out what we do about it.
Returns and the 30 night guarantee
Our 30 night guarantee, and how to use it, is set out in our refund policy, which forms part of these terms.
Nothing in that policy or these terms removes or reduces your statutory rights as a consumer, including any statutory right to cancel.
Intellectual property
The Vespré name, our logo, our website design, our photography and our written content belong to us and are protected by intellectual property law.
You may view and share our pages normally. You may not copy, reproduce, republish or use our content for commercial purposes without our written permission.
Using our website
You agree not to use our site for anything unlawful, not to attempt to gain unauthorised access to it, not to interfere with its operation, and not to introduce malicious code.
We may suspend access if we reasonably believe you are doing any of these things.
Reviews and anything you send us
If you send us a review, a photograph or feedback, you allow us to use it in connection with our business, with attribution to your first name only unless you tell us otherwise. You keep ownership of it.
We do not publish invented reviews, and we do not edit a review to change its meaning.
Third-party links and services
Our site may link to sites and services we do not control, and our store relies on third parties including Shopify, payment processors, carriers and advertising platforms. We are not responsible for their content, their availability, or their privacy practices.
Availability of the site
We aim to keep the store available, but we do not guarantee uninterrupted access. We may suspend it for maintenance, updates, or reasons outside our control, without liability to you.
Our liability to you
We provide our site and our products with reasonable care and skill.
To the extent the law allows, we are not liable for indirect or consequential loss, for loss of profit, or for loss arising from your use of a product in a way it was not intended. Our total liability to you in connection with any order is limited to the amount you paid for that order.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
Your statutory rights
Nothing in these terms affects your statutory rights as a consumer. If any part of these terms conflicts with a right you have by law, the law takes precedence.
Events outside our control
We are not liable for delays or failures caused by events outside our reasonable control, including carrier disruption, extreme weather, supplier failure, industrial action, or the actions of customs authorities. Where such an event causes significant delay, you may cancel an undelivered order for a full refund.
Governing law and jurisdiction
These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales.
If you are a consumer resident elsewhere, this does not deprive you of the protection of the consumer law of your own country, and you may have the right to bring proceedings there.
Other terms
If any part of these terms is found to be unenforceable, the rest continues to apply.
If we do not enforce a term straight away, that does not mean we have given it up.
These terms, together with our refund, shipping and privacy policies, are the entire agreement between us about your order.
Changes to these terms
We may update these terms. The version that applies to your order is the one published when you placed it. The date below tells you when they last changed.
